Ethara Advisory (“Ethara”, “I”, “me”) is committed to protecting the privacy of personal information collected through this website and through engagements. This Privacy Policy explains what information is collected, how it’s used, and your rights in relation to that information.

Some of my work — in particular workplace investigations — involves collecting sensitive information as defined in the Privacy Act 1988 (Cth). This can include information about a person’s health, and information about alleged or actual conduct, and it may relate to people other than the person who engaged me, including complainants, respondents and witnesses.

Where I collect sensitive information:

I collect it only where it is reasonably necessary for the engagement, and — unless an exception under the Privacy Act applies (for example, where the collection is required or authorised by law, or is reasonably necessary to establish, exercise or defend a legal claim) — I do so with consent.
Sensitive information collected during an investigation or other engagement is handled under the confidentiality and information-handling terms of that specific engagement, in addition to this Policy.
Access is restricted, and the information is used only for the purpose of the engagement and to meet related legal obligations.

This website is not used to collect sensitive information. Please do not include sensitive information in the website contact form or document-download forms.

3. How I use your information

I use personal information to:

Send you occasional email updates (where you’ve opted in)

If you are not satisfied with my response, or I have not responded within a reasonable time, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

If a data breach occurs that is likely to result in serious harm to any individual whose personal information I hold, I will respond in line with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the OAIC where required.
